The Delhi High Court on Tuesday stayed the bail granted by the trial court to Delhi Chief Minister Arvind Kejriwal in the liquor policy case.

The court observed the trial court did not appropriately appreciate the material on record while granting the bail.

Pronouncing the order on Enforcement Directorate's plea challenging bail granted by Rouse Venue Court to Kejriwal in the liquor policy case, JusticeSudhir Kumar Jain observed the averments and allegations made in the main petition require due consideration of the court, Live Law reported. The top court said the trial court did not rightly discuss the conditions under the Prevention of Money Laundering Act and vicarious liability of Kejriwal under section 70 PMLA.

"This court has decided that the vacation judge did not appropriately appreciate the material on record and the averments of ED. Accordingly, the application is allowed and the operation of the impugned order is stayed," as reported by Live Law.

Special Judge Niyay Bindu granted bail to the chief minister on June 20. The ED approached the High Court challenging the order the next day. While granting bail, the trial court observed ED was biased against Kejriwal and it failed to establish the money trail against Kejriwal.
