Another setback for Delhi Chief Minister Arvind Kejriwal, as the Supreme Court on Monday, June 24, refused to allow bail to Delhi Chief Minister Arvind Kejriwal.
The apex court said that they would wait for the High Court order.
The court noted that the Delhi HC is likely to pronounce the order on ED plea against bail, in a day or two. "If we pass the order now, we'll be pre-judging the matter being heard by a High Court."
The court has directed the chief minister's plea to be heard on June 26.
Chief Minister Arvind Kejriwal's counsel told the Supreme Court that the trial court granted him bail on June 20 and the enforcement directorate mentioned the plea before the Delhi High Court and managed to get a stay. "Unprecedented for a stay to be granted during mentioning in Delhi HC, the HC prejudged the matter, even order copy was not available," the counsel said.
If the high court can stay the order at only mentioning, without order, why can't the supreme court do it, the defence questioned. "If the Trial court judgment granting bail is found to be bad, Kejriwal can be asked to go back to jail, no question for a stay of bail."
The Delhi CM Kejriwal is not a flight risk, the defence asserted. The trial court heard arguments for five and a half hours across two days, before granting bail.
